Limited Warranty Terms and Conditions

Stacktrail Cash and Carry Private Ltd (“Seller”) warrants against defects in material and workmanship (“Defect”) in the Efferv branded products contained in the original packaging (“Product”), subject to the conditions as set out herein.

Warranty Terms:

• This warranty policy applies only to Products sold in India.
• A Product having a Defect shall be replaced free of charge, in accordance with these terms, at the store/centre from which the Product was purchased (“Store”). Provided however, the Seller may at its sole discretion, provide any other solution in response to the receipt of a Product with Defect.
• Warranty Duration: The Warranty Period for each of the Products shall be as mentioned below and shall be calculated from the date of the purchase of the relevant Product:

• To avail warranty services, customers shall have to visit the Store along with the original GST invoice.
• Where the Product has exceeded the Warranty Period as set out above, the Product will be counted as Out of warranty and shall cease to be covered under the Warranty.
• A valid proof of purchase is mandatory to produce at the Store to avail warranty service.
• Warranty is available only during the Warranty Period and against manufacturing defects.
• Warranty shall be provided in case of any functional failure of the Product due to Defects.
• The Warranty to the products is subject to the exclusions as set forth below.
• No temporary back-up / replacement of the Product will be given to the customer for the time period the Store processes the customer’s request for replacement.
• The Warranty in respect of replaced Product (if any) shall continue and remain in force for the unexpired Warranty Period of the original Product.

Exclusions / Exceptions to the Warranty:

This Warranty shall not cover the following:

• Warranty Period on the Product has expired.
• No valid GST invoice is presented.
• Unauthorized repair of the Product through the third party.
• The Product has been opened, self-repaired, unscrewed and/or re-assembled by anyone (including any third party or the customer itself) other than at the Store.
• The Product seal, serial number code or the accessory date code has been removed, defaced or altered.
• The Product is subject to abnormal use or conditions, improper use (such as falling, accident, breaking, squeezing, improper handling, water damage, etc.), exposure to excessive moisture or dampness, exposure to excessive temperatures, unauthorised modifications, unauthorised repair (including but not limited to use of unauthorised spare parts in repairs)
• The Product is damaged due to acts of god (such as power outage, short circuit, floods, fires, earthquakes, lightning strikes and traffic accidents).
• Failure to use and maintain the Product according to the instructions and/or using the Product outside of its intended use (such as, use under extreme temperatures, use of other accessories, etc.).
• Natural wear and tear of the Product (for example cable, connector, etc.), including any damage of plastic components.
• The cables provided with chargers and power banks shall not be subject to the warranty terms.

Miscellaneous:

• To the extent permitted by law, this Warranty and the remedies set forth are exclusive and in lieu of all other warranties, remedies and conditions, whether oral, written, statutory, express or implied. Seller disclaims all statutory and implied warranties, including without limitation, warranties of merchantability and fitness for a particular purpose and warranties against hidden or latent defects, to the extent permitted by law. In so far as such warranties cannot be disclaimed, seller limits the duration and remedies of such warranties to the duration of this express warranty and, at seller’s option, the replacement services described as herein.
• Limitation of liability: Except as provided in this Warranty and to the maximum extent permitted by law, the Seller is not responsible for direct, special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of business; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, compromise or corruption of data; or any indirect or consequential loss or damage howsoever caused including the replacement of product and property.
• All disputes shall be governed under the laws of India and are subject to the jurisdiction of the Courts of Bangalore only.
